Terms of service.

MatchKo is operated by Chimney Studios ("MatchKo," "we," or "us"), based in Oshawa, Ontario, Canada. By accessing or using matchko.com and any related services, you ("you" or "user") agree to these Terms of Service.

If you do not agree, do not use the service. If you are using MatchKo on behalf of an organization, you represent that you have the authority to bind that organization.

• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
• You must provide accurate, current, and complete information during registration.
• One account per person. Do not create accounts on behalf of others or share a single account between multiple people.
• You are responsible for keeping your login credentials secure and for all activity under your account.
• Notify us immediately at support@matchko.com if you suspect unauthorized access.

MatchKo offers a Free tier and a Pro tier. Current pricing is published at matchko.com/#pricing.

• Pro subscriptions are billed via Stripe. We never see or store your card details.
• You can choose monthly or annual billing. Annual plans are discounted.
• Subscriptions auto-renew at the end of each billing cycle until canceled.
• You can cancel anytime from Settings > Billing. Cancellation takes effect at the end of the current billing period.
• Failed payments may result in access being downgraded to Free until resolved.
• Taxes may apply based on your location and are added at checkout.

• First-time Pro subscribers can request a full refund within 14 days of their initial payment — no questions asked.
• Refunds are not offered for second-time or returning Pro subscribers.
• Pro-rated refunds (for example, in case of extended service outage) are handled case by case. Email support@matchko.com.
• Annual subscriptions canceled mid-term receive a pro-rated refund for unused months only within the first 30 days of the annual term.

You may:

• Use MatchKo to generate tailored documents for your own job applications.
• Upload resumes, cover letters, and application materials that you own or have permission to use.
• Connect your own Gmail or Google account to create drafts in your own account.

You may not:

• Scrape, reverse-engineer, or systematically extract data from MatchKo.
• Resell, sublicense, or provide MatchKo's generated outputs as a service to third parties.
• Use MatchKo for non-employment-related purposes (for example, generating fake resumes, identity documents, or fraudulent materials).
• Violate any law, regulation, or third-party right in connection with the service.
• Impersonate another person, upload resumes or personal data that do not belong to you, or misrepresent your identity.
• Introduce malware, attempt to bypass rate limits, or probe the service for vulnerabilities without written permission (see our security page for responsible disclosure).
• Use the service to train, benchmark, or develop a competing product.

• You retain all rights to the resumes, personal information, and any source material you upload. We do not claim ownership of your content.
• You own the generated documents (tailored resumes, cover letters, application emails) produced by MatchKo for your account. We grant you an unlimited, perpetual license to use them however you want.
• You grant us a limited, non-exclusive, worldwide license to store, process, and transmit your content solely to operate and provide the service. This license ends when you delete the content or your account.
• You represent and warrant that you own or have permission to upload all content you submit, and that the content does not violate any third-party rights.

MatchKo, the MatchKo brand, the website design, document templates, code, and all underlying software are owned by Chimney Studios and protected by copyright, trademark, and other IP laws. We grant you a limited, non-exclusive, non-transferable license to use the service as intended by these terms. Nothing in these terms transfers ownership of our IP to you.

• MatchKo uses AI to generate tailored documents. AI output can contain errors, omissions, or phrasing that may not fit your situation.
• You are responsible for reviewing every document before submitting it to a recruiter, ATS, or employer.
• MatchKo does not guarantee a job interview, job offer, or any particular hiring outcome.
• We make a best effort to ensure generated resumes parse cleanly in common ATS systems, but we cannot guarantee compatibility with every possible ATS configuration.
• The service is a tool to assist your application process — it does not replace your judgment, your experience, or your final review.

• Connecting your Google account is entirely optional and user-initiated.
• We request only the Gmail scopes required to create drafts on your behalf (gmail.compose or equivalent).
• We never read, send, or delete messages outside of drafts we create.
• All drafts go directly to your Gmail drafts folder. You review and send them manually.
• You can revoke MatchKo's access at any time from Settings > Integrations or from your Google Account security page.

• We aim for high uptime but do not guarantee uninterrupted service.
• Planned maintenance windows are announced in advance via email or in-app banner where reasonable.
• The Free tier is provided without any Service Level Agreement (SLA).
• Pro tier users experiencing extended outage may request a pro-rated credit per section 4.

• You may terminate your account at any time from Settings > Account > Delete Account.
• We may suspend or terminate your account for violations of these terms, typically with reasonable notice. Immediate termination is reserved for security incidents, legal requirements, or clear abuse.
• On termination, access to the service ends. Your data is hard-deleted within 24 hours unless legally required to retain (billing records).
• Sections relating to ownership, liability, indemnification, and governing law survive termination.

MatchKo is provided on an "as is" and "as available" basis. To the maximum extent permitted by law:

• We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost opportunities, or lost data.
• Our total aggregate liability to you for any claim arising out of or related to the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100.
• Some jurisdictions do not allow these limitations; in those places, our liability is limited to the minimum extent permitted by law.

You agree to indemnify and hold harmless MatchKo, Chimney Studios, and their respective officers, directors, and employees from any third-party claim arising out of your violation of these terms, your misuse of the service, or your infringement of any third-party right. We agree to indemnify you against claims that the service, as provided by us, infringes a third party's intellectual property, subject to standard exceptions and caps aligned with section 12.

These terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of laws principles. Any dispute arising out of or relating to these terms will be resolved in the courts of Ontario, Canada, and you consent to their exclusive jurisdiction.

We may update these terms from time to time. Material changes will be notified by email and in-app banner at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.
